The ELD Mandate

In 2012, Congress passed the “Moving Ahead for Progress in the 21st Century” bill, more commonly referred to as MAP-21.  Part of that bill included a provision requiring the FMCSA to develop a rule mandating the use of electronic logging devices (ELDs).  ELDs are used to create an electronic record of a driver’s Record of Duty Status (RODS) and were designed to replace paper logbooks previously used to record a driver’s compliance with Hours of Service (HOS) requirements.  The bill gave motor carriers until December 2017 to implement the new ELD requirements. 

Following a short “soft enforcement” period, roadside enforcement personnel throughout the U.S. have begun enforcing the ELD mandate, placing drivers out of service and levying fines at their discretion.
